Implementation of occupation-related German language support
The implementation of occupation-related German language support is the responsibility of the Bundesamt für Migration und Flüchtlinge (Federal Office for Migration and Refugees). To implement occupation-related German language support, the Federal Office admits private and public providers. The Federal Office takes into account those of the Bundesagentur für Arbeit (Federal Employment Agency) and of the bodies responsible for implementing the basic income support for jobseekers.

When participating in occupation-related German language support, the concerns of people with disabilities and accessibility shall be given particular consideration.
Personal scope of application of the ordinance
The ordinance applies to foreign nationals within the meaning of Section 2(1) of the Residence Act and to foreign nationals whose legal status is determined under the Freedom of Movement Act/EU.
The ordinance applies correspondingly to German nationals with a migration background.
Objective of occupation-related German language support
Occupation-related German language support serves language acquisition in order to improve opportunities on the labour and training market.
Framework conditions for participation
Participation in occupation-related German language support
Persons may receive an entitlement to participate in occupation-related German language support if the occupation-related German language support is necessary. A service of the Federal Ministry of Justice and Consumer Protection and of the Federal Office of Justice – www.gesetze-im-internet.de
- in order to improve their opportunities on the labour or training market and, at the time the entitlement to participate is granted,
a) they are registered with the Agentur für Arbeit (Employment Agency) as seeking training, seeking work or unemployed, or are supported under measures pursuant to the Second Subsection of the Third Section of the Third Chapter or Section 74(1) sentence 2 of Book III of the Social Code,
b) they receive benefits under Book II of the Social Code, or
c) they are in employment without belonging to the group of persons under letters a or b, - because, alongside the recognition of foreign professional qualifications or for access to the profession, they must attain a particular language level,
- in order to support them as trainees during vocational training within the meaning of Section 57(1) of Book III of the Social Code in carrying out and successfully completing the training, or
in order to support them in preparing for vocational training within the meaning of Section 57(1) of Book III of the Social Code - and they have concluded a training contract.
Persons with a tolerated stay (Duldung) may receive an entitlement to participate in occupation-related German language support only if
- the tolerated stay has been granted under Section 60a(2) sentence 3 of the Residence Act, or
- the conditions under subsection 1 sentence 1 number 1 letter a or c or number 3 are met and they have been residing in the federal territory with a tolerated stay for at least six months.
For persons who hold a residence permission under the Asylum Act, Section 45a(2) sentences 3 and 4 of the Residence Act must be observed. Persons whose residence or habitual abode is in border areas of the Federal Republic of Germany may receive an entitlement to participate in occupation-related German language support if the conditions under sentence 1 number 1 letter a are met.
Sentence 4 applies only if the entitlement to participate is granted within the framework of a joint project of the Bundesagentur für Arbeit with the neighbouring state in which the person’s residence or habitual abode is located, and in which the neighbouring state also offers comparable language support measures for persons with residence or habitual abode in the Federal Republic of Germany. Persons whose residence or habitual abode is not in the Federal Republic of Germany may receive an entitlement to participate in occupation-related German language support if the conditions under sentence 1 number 4 are met and the training contract has been entered in the register of vocational training relationships at the competent body or, where such entry is not required, the training contract has been concluded with a state or state-recognised training institution or the consent of a state or state-recognised training institution to the training contract is available. For third-country nationals it is additionally required that the Bundesagentur für Arbeit has granted consent under Section 39 of the Residence Act for the issuance of a residence title under Section 16a of the Residence Act, where such consent is required.
Persons under Section 2 who are obliged in an integration agreement under Book II of the Social Code or on the basis of an administrative act replacing it to participate in occupation-related German language support are to be given priority under Section 8(3). Persons who hold a residence permission under the Asylum Act and for whom a lawful and permanent stay is to be expected are to be given priority in the same way.
Participation in occupation-related German language support presupposes sufficient German language skills corresponding to level B1 of the Common European Framework of Reference for Languages (Section 2(11) of the Residence Act). This does not apply to participation in special occupational language courses under Section 13(1) sentence 1 numbers 3 and 4.
For participation in occupation-related German language support, employed participants must pay a cost contribution to the Federal Office. This does not apply to
- employees who, alongside employment, receive benefits under the Asylum Seekers’ Benefits Act, Book II of the Social Code or assistance towards living expenses under Book XII of the Social Code, or who are entitled to unemployment benefit,
- trainees who are completing vocational training within the meaning of Section 57(1) of Book III of the Social Code or an introductory qualification within the meaning of Section 54a of Book III of the Social Code.
